The applicant is apprehending arrest in connection with Crime No.1580/2025, registered with Police Station Wardha, for offences punishable under Sections 316(2),308(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Issue notice to the non-applicant, returnable on 9.2.206.

Learned APP waives notice for non-applicant.

The allegation against the applicant is that he has used the account of the informant for his own use and credited the amount in his own account without knowledge of the informant and thereby committed misappropriation.

Considering the submission and the fact that the case diary is not before this Court, a case for ad interim relief is made out. Hence, following order:

i) Pending the application, in the event of arrest, in connection Crime No.1580/2025, registered with Police Station Wardha, for offences punishable under Sections 316(2),308(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 the applicant be released on furnishing a P.R. bond of Rs. 25,000/- with one solvent surety in the like amount.

ii) The applicant shall attend the concerned Police Station on 30.1.2026, 11.2.2026 and 18.2.2026, between 10.00 to 12.00 hrs.

iii) The applicant shall not tamper with the prosecution evidence and shall cooperate in the investigation.
