This is an application for anticipatory bail. 2.
The applicant is apprehending his arrest in Crime No.314 of 2025 registered at Vasai Police Station for the offences punishable under Sections 318(4), 336(3), 340(2), 338, 316(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023.

I have heard the learned counsel appearing for the applicant, the learned APP for the respondent / State and the first informant in person.

Learned counsel for the applicant submits that the first informant was working as Nurse at the Old Age Home run by the applicant. It is submitted that the parties have amicably settled their their disputes. It is submitted that pursuant to the said Dinesh S. Sherla 1/2
911-aba-59-26.doc settlement, the applicant is ready to pay an amount of Rs.5,29,500/- which were allegedly withdrawn by the applicant from the bank account of the first informant. The first informant, who is present in the Court admits receipt of demand draft of Rs.5,29,500/-. She agreed to give no objection, if the application for quashing of the FIR is filed. She further agreed to withdraw the complaint made by her to the Office of Charity Commissioner, Palghar against the applicant. She, however, submits that the applicant be directed not to defame her in future. 6.
Learned counsel for the applicant, on instructions, states that the applicant would not indulge in any act prejudicial to the reputation of the first informant. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail on certain conditions. In the result, the following order is passed.
ORDER
A) The Application is allowed.
B) In the event of arrest of the applicant in C.R. No.314 of 2025 registered at Vasai Police Station for the offences punishable under Sections 318(4), 336(3), 340(2), 338, 316(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.
D) The applicant shall not contact the victim.
