The applicant is apprehending his arrest in connection with Crime No.515/2025 registered with Police Station, Khamgaon City, District Buldhana, for the offences punishable under Sections 420, 471 read with Section 34 of the Indian Penal Code (IPC).

The applicant is the husband of the informant. It appears that there is marital discord between them. The informant alleged that the applicant had taken cash to the tune of 2,00,000/- and gold ornaments from her before ₹ they got married and made an agreement in respect of that on two stamp papers of 100/- each. After the separation, he ₹ did not return the same and therefore, she had lodged FIR No.605/2023 for the offences punishable under Sections 406, 420, 498A read with Section 34 of the IPC.

It is submitted that, the informant came to know that the stamp papers which were used for executing the agreement in the aforesaid transaction were not purchased in the name of the applicant. Instead, they were purchased by one Shri Uday Ambadas Mohite and one Shri Prakash Babusa Parkhede, residents of Aasa from Shri V.S. Deshpande (co-accused). Therefore, the aforesaid offence came to be registered against the applicant.

Considering the submissions and contents of the FIR, perusal of case the dairy is required, which is not available at present. Considering the submissions, a case is made out for grant of ad interim protection. Hence, the following order:
ORDER
(i) Pending the application, in the event of arrest, the applicant - Iliyas Ahmad Riyaz Ahamad, in connection with Crime No.515/2025 registered with Police Station, Khamgaon City, District Buldhana, for the offences punishable under Sections 420, 471 read with Section 34 of the Indian Penal Code, be released on bail on executing a PR bond of 25,000/- with one solvent surety in the like ₹ amount.
(ii) The applicant shall attend the concerned Police Station on 6th and 10th February 2026 between 10.00 am to 02.00 pm and cooperate with the investigating authority. (iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
