P. C. :
1.
The Applicant is apprehending arrest in connection with Crime No. 930 of 2025 registered with Pandharpur Taluka Police Station, District Solapur for the offences punishable under sections 118 (2), 118 (1), 115 (2), 352, 351 (1), 351 (2) and 3 (5) of the Bhartiya Nyaya Sanhita, 2023. 2.
Heard the learned counsel for the Applicant and the learned A.P.P, for Respondent - State.
3.
Having gone through the case diary, it appears that there is a dispute between the complainant and the accused persons in respect of agricultural land. On 28th December 2025, the Applicant along with other co-accused
persons objected to the complainant ploughing the agricultural land. It is alleged that the Applicant and the co-accused abused the complainant. The Applicant was allegedly armed with a stick and is stated to have assaulted the complainant on the head with the said stick as a result of which, the complainant sustained a bleeding injury. It is further alleged that the Applicant and the co-accused also assaulted the complainant by means of fists and blows. On alarm being raised by the complainant, people from the village gathered at the spot, intervened and rescued the complainant. Thereafter, on the basis of the complaint lodged by the complainant, the aforesaid offences came to be registered against the Applicant.
4.
The specific role attributed to the present Applicant is that he assaulted the complainant on the head with a stick.
5.
It appears that a counter FIR has also been lodged by the Applicant in respect of the same incident against the complainant. It further appears that the Applicant also sustained injuries in the said occurrence. Thus, it prima facie indicates that there was a free fight between the complainant on one hand and the Applicant along with his family members on the other hand. 6.
It is submitted by the learned A.P.P. that the stick has already been recovered and the investigation has been completed. The Applicant was protected by way of interim relief with a direction to attend the concerned Police Station and co-operate with the investigation. The Applicant has accordingly appeared and co-operated with the Investigating agency. 7.
In view of the aforesaid facts, a case is made out for confirmation of the interim order dated 18th February, 2026. Hence, the following order:
(i) The interim order dated 18th February, 2026 is hereby confirmed. (ii) The applicant shall appear before the concerned Police station as and when directed by the Investigating Officer.
8.
With this, the Application stands disposed of. [M. W. CHANDWANI, J.]
