Heard the learned counsel for the applicant and learned APP for non-applicant/State. I have gone through the record. 2.
The applicant is seeking anticipatory bail in connection with Crime No. 14/2026, registered with Police Station, Digras, Dist. Yavatmal, for offences punishable under Sections 78, 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 12 of the Protection of Children From Sexual Offences Act, 2012. 3.
It appears that the victim, a minor girl is being stalked by the applicant. It is alleged that on 8.1.2026, between about 3.30 p.m. to 4.00 p.m., when the victim was cleaning the courtyard of her house, the applicant came there and insisted the victim to get married to him. On the victim's refusal, the applicant threatened that he will commit suicide by pouring kerosene on himself and setting himself on fire. It is also alleged that the applicant was following the victim even prior to this incident and therefore, on the complaint of the cousin brother of the victim, the aforesaid offences came to be registered against the applicant.

It appears that the applicant is a teenager. There is no allegation of sexual assault or physical contact by the applicant with the minor victim girl. The applicant is a young boy who has a future ahead of him. Nothing is required to be seized from the applicant and therefore, his custodial interrogation may not be required. The applicant was protected by ad interim order with a direction to attend the concerned Police Station. Accordingly, he has attended the concerned Police Station and cooperated in the investigation.
Considering these aspects, a case is made out for confirmation of the ad interim relief subject to certain conditions. Hence, the following order:
i) The order dated 03.02.2026 is hereby confirmed on the same conditions, except condition No. 7(ii).
ii) The applicant shall appear before the concerned Police Station as and when directed by the Investigating Officer and shall not tamper with the prosecution evidence. iii) The applicant shall not contact the victim or repeat the incident of stalking. So also, he shall not enter village Varandali, of Tq Digras, Dist Yavatmal, till filing of the charge sheet.
