Applicant No. 2 Veer Sagar Sonvane is apprehending arrest in connection with Crime No. 786/2025 registered with Police Station, Karvir, Dist. Kolhapur for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 324(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2.

Heard the learned counsel for the Applicant and learned APP for the non-applicant State.

Having gone through the case diary, it appears that the father of the Applicants i.e. Sagar and the Complainant were known to each other. On 12.12.2025, an altercation took place between the father of the Applicants and the Complainant on account of the missing car key of the Complainant. The Complainant accused the father of the Applicants that he had taken the key but in fact, it was in the vehicle itself. On this count, the father of the Applicants got annoyed and abused him. Thereafter, when the

Complainant came to Nila Chowk, Kalamba, the father of the Applicants along with Applicant No. 2 and his brother Applicant No. 1-Yash came there and took out the key. The father of the Applicants brought a sickle and assaulted the Complainant on his chest and back whereby, he sustained bleeding injury.

The role assigned to Applicant No. 2 is that he assaulted the Complainant on his back and stomach by means of a stick. The Complainant was initially admitted in CPR Hospital and thereafter, shifted to Aster Adhar Hospital, Kolhapur. On the next day, the report came to be lodged by the Complainant and the aforesaid offence came to be registered against the Applicants and other co-accused.

The contention is that Applicant No. 2 is a 17 year old boy and a juvenile in conflict with law. Applicant No. 1 has already been arrested. The Chargesheet has been filed. There are no criminal antecedents of Applicant No. 2. Therefore, he may be protected by way of anticipatory bail.

Learned APP submitted that after recording a detailed statement of the Complainant, Section 109 was added. No doubt, the father of the Applicants used a sickle as a weapon of offence and also assaulted the Complainant on his Chest and hand. However, Applicant No. 2 is a minor and a juvenile in conflict with law. The role assigned to Applicant No. 2 is of assault by means of stick. No deadly weapon was used by Applicant No.2.

So far as the recovery of the stick is concerned, it appears that the stick is already recovered from Applicant No. 2. Nothing is required to be seized, since the charge-sheet has been filed against the other coaccused which goes to suggest that investigation is completed in all aspects. It appears that the father of the Applicants is also sustained

grievous injury and a cross FIR has been lodged by the father of the Applicant against the Complainant.

Considering the fact that nothing is required to be seized from Applicant No. 2 and that he is a juvenile in conflict with law, a case is made out for confirmation of the interim order dated 16.02.2026. Hence this order :

I.

Application is allowed.

II.

The interim order dated 16.02.2026 is hereby confirmed. III.

Applicant No.2 Veer Sagar Sonavane shall appear before the Juvenile Justice Board as and when directed by the Board. [M. W. CHANDWANI, J.]
