The applicant is apprehending his arrest in connection with Crime No.507/2025 registered with Police Station, Chimur, District Chandrapur for the offences punishable under Sections 115(2), 118(1), 296, 3(5), 351(2), 351(3) of the Bhartiya Nyaya Sanhita, 2023 (for short "BNS, 2023").

Perusal of the case diary reveals that on 02.12.2025 at about 06.30 pm, when the complainant alongwith his friend was standing in front of Buddha Vihar in Azad Ward, the applicant came there, holding an iron rod in his hand and he also called another co-accused. One of them assaulted the complainant by means of fists and kick blows. Thereafter, the applicant also tried to assault the complainant by means of the iron rod, as a result of which he sustained scratches near his left eye. Therefore on his complaint, the aforesaid offence came to be registered against the applicant and other co-accused.

Though, an offence punishable under Section 118(2) of the BNS, 2023 has been registered against applicant and other co-accused, the injury report reveals that there was simple injury. The victim was immediately discharged from the hospital after receiving primary treatment. 4.

No doubt there are criminal antecedents of the present applicant, however, considering that the nature of injury is simple as well as nature of allegations against the applicant, a case is made out for confirmation of the interim order dated 04.02.2026.

It is also reported that the pursuant to interim order dated 04.02.2026, the applicant appeared before the investigating officer and cooperated in the investigation. 6.

Accordingly, the application is allowed. The interim order dated 04.02.2026 stands confirmed on same terms and conditions except the condition mentioned at para 8. 7.

The applicant shall attend the concerned police station as and when directed by the investigating officer. 8.
