The applicants are apprehending their arrest in connection with Crime No.428/2025 registered with Police Station, Amdapur, District Buldhana for the offences punishable under Sections 118(1), 118(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2.
Heard learned counsel for the applicants as well as learned APP for the non-applicant/State.

Perusal of the case diary reveals that there is a dispute between the applicants' family and the complainant's family on account of right of way and civil suit is pending to that effect. The allegations are that on 21.12.2025 at about 07.30 pm when the complainant was proceeding towards his home, the present applicants alongwith co-accused Amol Lahudkar stopped the car and alighted from the car in front of the complainant. They beat the complainant asking as to why he has lodged a false complaint against them. In the
said assault, the complainant has sustained injury on his right side I.P. joint, little finger and left elbow joint. 4.
Allegations against the applicants are that applicant Manoj Lahudkar, by means of iron sprinkler pipe and applicant - Nilesh Lahudkar, by means of an iron motorcycle shock-up assaulted and abused the complainant; whereas, applicant - Pradip assaulted by means of wooden stick. 5.
It appears that, initially the offence under Section 118(1) came to be registered, however, subsequently it was revealed that there is a fracture to the little finger of the complainant and therefore, Section 118(2) of the BNS was added. The complainant was immediately discharged from the hospital. There is no chance of the offence aggravating further. The FIR has been lodged after a delay of two days. No doubt, prima facie, there is involvement of the present applicants in the crime however considering the fact that the iron sprinkler pipe, the motorcycle shock-up as well as the wooden stick are already recovered, custodial interrogation of the applicants will not be required.

Considering these aspects, a case is made out for grant of anticipatory bail. Hence, the following order:
ORDER
(i) The criminal application is allowed.
(ii) In the event of arrest, in connection with Crime No.428/2025 registered with Police Station, Amdapur, District Buldhana for the offences punishable under Sections 118(1), 118(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicants (1) Manoj Sarangdhar Lahudkar, (2) Nilesh Arun Lahudkar and (3) Pradip Madhukar Lahudkar shall be released on bail on furnishing a PR bond of Rs.25,000/- each with one solvent surety each in the like amount.
(iii) The applicants shall attend the concerned Police Station on every Monday and Friday between 10.00 am to 12.00 noon, till filing of the charge-sheet, and cooperate with the investigating authority.
(iii) The applicants shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. With this, the application stands disposed of. (M.W. Chandwani, J.) Wagh
