The applicant seeks anticipatory bail in connection with Crime No. 1478/2025 registered with Police Station Hinganghat, Dist. Wardha for the offences punishable under Sections 118(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

Heard the learned counsel for the applicant as well as the learned APP for the State. I have gone through the case-diary.

It appears that on 28.10.2025 at about 12:15 pm, the informant along with his brother and friend were attending the marriage procession of the informant's friend- Milind Narse. The juvenile in conflict with law came there on a motor-cycle along with his friend from the wrong side of the road. On that count, there was a quarrel between the juvenile in conflict with law and the

2 63-aba-89-26.odt informant. Thereafter, the juvenile in conflict with law went away to his house and came along with his father, the applicant. The juvenile in conflict with law assaulted the informant with a wooden rafter on the head. The allegation against the present applicant is that he has assaulted the informant on his left hand by means of wooden stick, whereby he sustained a fracture. 5.

It appears that the incident occurred due to an altercation between the informant and the juvenile in conflict with law. The applicant is the father of the juvenile in conflict with law, who also assaulted the informant which has resulted into fracture of the left hand of the informant.

Considering the genesis of the incident, the nature of allegation against the applicant, coupled with the fact that the informant has already been discharged from the Hospital, a case is made out for grant of extraordinary relief of anticipatory bail to the applicant. 7.

Sofaras, the anxiety of the prosecution regarding recovery of the rafter is concerned, attendance of the applicant before the Investigating Officer can be treated as custody under Section 23 of the Bhartiya Sakhshya Adhiniyam, 2023. Hence, the following order:- i) In the event of arrest, applicant- Kailassing Darasingh Bhada shall be released on bail on furnishing a P.R. bond of Rs.25,000/- with one solvent surety in the like amount in connection with Crime No. 1478/2025

Wardha for the offences punishable under Sections 118(2), 352, 351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. ii) The applicant shall attend the concerned Police Station between 10:00 am to 12 noon on every Tuesday and Friday for the next three weeks and shall cooperate in the investigation. iii) The application is disposed of accordingly.
