This is an application for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 427 of 2025 registered at Tardeo Police Station for the offences punishable under Sections 316(2), 318(4), 319(2), 336(2), 336 (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

It is the case of the prosecution that the first informant had let out the premises owned by him to the present applicant. It is alleged that the present applicant in connivance with other coaccused got prepared the false documents and inducted one Majid Ali Shaukat Ali as a tenant in the said premises by accepting Rs.15 Lakhs from him. The allegations against the applicant and other co-accused are of thus cheating and forgery.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 5.

Learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the applicant has not accepted any amount from the said Majid Ali Shaukat Ali Shaikh. It is submitted that there is no need of custodial interrogation and the applicant is ready and willing to cooperate in the investigation.

On the other hand, learned APP for the respondent/State submits that the applicant is involved in serious offence of cheating & forgery. It is submitted that the applicant is involved in one more crime of similar nature. It is submitted that considering the nature of crime, the present applicant may not be released on anticipatory bail.

I have perused the statement of Majid Ali Shaukat Ali Shaikh. There is no reference of the present applicant in his statement. All the allegations are against the co-accused Irfan Shaikh and Mohd. Irfan Qureshi. Considering the said fact, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No.427 of 2/3

2025 registered at Tardeo Police Station for the offences punishable under Sections 316(2), 318(4), 319(2), 336(2), 336 (3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 , he be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one surety or two sureties in the like amount.

C) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall cooperate in the investigation.
