Heard the learned counsel appearing on behalf of the applicant and the learned A.P.P. appearing on behalf of the State. Perused the case diary.

The applicant is apprehending arrest in connection with Crime No. 875/2025 registered with Police Station, Kanhan, Dist. Nagpur for the offences punishable under Sections 143, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under Sections 3 and 5 of the Immoral Traffic (Prevention) Act, 1956 (for short "the Act of 1956") 3.
It appears that on receipt of secret information that a brothel is being run at Rainbow Lodge situated at Mouza Tekadi and the victims are being induced for prostitution, the police in order to lay a trap, sent a decoy customer at Rainbow Lodge. The decoy customer, after having a conversation with the Manager of the said hotel/lodge and the victim girl, went into a room along with the victim. He paid Rs.500/- to the Manager and Rs.500/- to
2 81 aba99.26.odt the victim girl. Thereafter, on a signal given by the decoy customer, a raid was conducted at Rainbow Lodge. 4.
After recording the statement of the victim, it was revealed that the applicant is the owner of Rainbow Lodge and is indulged in running a brothel by inducing the victims for prostitution. Therefore, the aforesaid offence came to be registered against the applicant and other coaccused Gaurav Dilip Sahare, the Manager of the lodge. The co-accused i.e. Manager was immediately arrested. 5.
The allegation against the applicant is of running a brothel and therefore, an offence under Section 3 of the Act of 1956 has been registered, which prescribes for maximum punishment for three years on the first conviction. So far as the allegation of inducing the victims for prostitution is concerned, it is covered under Section 5 of the Act of 1956 which prescribes for a minimum punishment of imprisonment for three years and maximum punishment for seven years.

It is informed that the investigation is complete and the charge-sheet has been filed. Considering the fact that the charge-sheet has already been filed, no purpose would be served by conducting custodial interrogation of the applicant. Nothing is required to be seized from the applicant.

Considering the role assigned to the applicant and the quantum of punishment, coupled with the factum of completion of investigation, a case is made out for grant
3 81 aba99.26.odt of anticipatory bail to the applicant. Hence, the following Order :
i) In the event of arrest of applicant- Manohar S/o Chirkut Hood in connection with Crime No. 875/2025 registered with Police Station, Kanhan, Dist. Nagpur for the offences punishable under Sections 143, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under Sections 3 and 5 of the Immoral Traffic (Prevention) Act, 1956, he be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount.
ii) The applicant shall attend the concerned Police Station on every Tuesday and Friday between 10.00 am and 12.00 noon for a period of three weeks and shall cooperate with the investigating agency. iii) The applicant shall not indulge in tampering with the prosecution evidence and shall not pressurize the prosecution witnesses in any manner.
iv) The application is allowed and disposed of.
