Both the Applications arise out of the same FIR and therefore, they are being disposed of by this common order. 2.
The Applicants are apprehending arrest in connection with Crime No. 3/2026 registered with Police Station, Kodoli, Dist. Kolhapur for the offences punishable under Sections 118(2), 118(1), 189(1), 189(2), 189(4), 191(2) and 191(3) of the Bharatiya Nyana Sanhita, 2023. 3.
Heard the learned counsel for the Applicant and the learned APP for the non applicant-State.

Having gone through the case diary, it appears that the Applicants are owners of the adjoining land of the Complainant, which Harish
31-ABA-99-2026 (CR).DOC they had sold to Akash Korgonkar and Raj Korgonkar. On 05.01.2026, when the Applicants along with other co-accused were trying to fix the boundary and measuring the land, the Complainant came there and objected to the same. The Applicants and other co-accused assaulted the Complainant by means of stick, iron rod and iron sattur. Therefore, on the complaint of Complainant, the aforesaid offence came to be registered against the Applicants. The Complainant was firstly admitted to CPR Hospital and thereafter, shifted to the Om Hospital, Kolhapur. 5.
The role assigned to the present Applicants is of throwing chilli powder in the eyes of the Complainant. Whereas, the other eight persons involved are accused of assaulting the Complainant by means of wooden sticks, iron rod and iron sattur.

It appears that all other accused have been arrested and weapons used in the crime are already seized from them. Nothing is required to be seized from the Applicants. The cross FIR has also been lodged by one of the co-accused, who also sustained injuries. 7.
The Applicants were protected by way of interim order dated 18.02.2026 with a direction to appear before the concerned police station and co-operate in the investigation. There is no complaint from the Investigation Officer that the Applicants did not co-operate. 8.
Considering the role assigned to the present Applicants and the fact that they are women, coupled with the fact that the charge-sheet has already been filed, a case is made out for confirming the interim order dated 18.02.2026. Hence this order :
I. Application is allowed.
