The applicant is seeking anticipatory bail in connection with Crime No. 365/2025, registered with Police Station Andhera, District Buldhana, for the offences punishable under Sections 303(2) of the Bhartiya Nyaya Sanhita, 2023 read with Section 48(7) and 48(8) of the Maharashtra Land Revenue Code, 1966.

Issue notice to the non applicant, returnable on 17.2.2026.

Learned APP waives notice on behalf of non-applicant/State.

It is contended that sand was found near the house of the applicant and therefore, the aforesaid offence of stealing sand came to be registered against the applicant along with other accused. The contention is that the sand does not belong to the applicant.

Considering the submissions, perusal of the case diary is required which is not available today. Hence, a case is made out for ad interim relief. In the result, following order: i) Pending the application, in the event of arrest, the applicant be released on furnishing a P.R. bond of Rs. 25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station every Tuesday and Friday, between 10.00 to 12.00 hrs. iii) The applicant shall not tamper with the prosecution evidence and shall cooperate in the investigation.
