Heard the learned counsel appearing for the applicant and learned A.P.P. for the non-applicant/State. Perused the case diary.

The applicant is apprehending arrest in connection with Crime No. 365/2025 registered with Police Station, Andhera, Dist. Buldhana for the offence punishable under Sections 303(2) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 48(7) and 48(8) of the Maharashtra Land Revenue Code, 1966.

It appears that on 11.12.2025, a raid was conducted at four places including a spot near the house of the present applicant where the Tahsildar and other revenue officers found 1.05 brass sand stored. Near the said sand, three Tippers were also found. The sand and the tippers were seized accordingly. A cumulative FIR in respect of four raids conducted by the revenue officials was lodged. 4.
The allegation against the applicant is of stealing
2 66 aba100.26.odt sand i.e. a minor mineral. The sand and the Tippers are already seized. Nothing is required to be seized from the applicant. The sand was found outside the house of the applicant. Whether the applicant is guilty of the offence or not is a matter of trial.

During the pendency of this application, the applicant was protected by ad-interim order of this Court dated 10.02.2026 with a direction to attend the concerned police. Accordingly, the applicant attended the concerned police station and cooperated in the investigation. 6.
Considering the nature of allegation against the applicant, the punishment prescribed and the fact that nothing is required to be seized from the applicant, a case is made out for confirmation of the ad-interim protection granted to the applicant.

Accordingly, the criminal application is allowed. 8.
The order dated 10.02.2026 granting ad-interim protection to the applicant is hereby confirmed on the same terms and conditions.

The applicant shall attend the concerned police station as and when directed by the Investigating Officer. 10.
The application stands disposed of.
