Heard Mr. Phatate, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP appearing for the Respondent-State.

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail in connection with C.R. No.169 of 2025 registered with Bhosari Police Station, Pune, for the offences punishable under Sections 3(5), 351(2), 352 and 118(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case is set out in paragraph No.2 of the order dated 22nd August 2025 passed by the learned Additional Sessions Judge, Pune in Criminal Bail Application No.4488 of 2025, which reads as under:

"2] The case of the prosecution in short is that, On 14/05/2025 at about 2:45 p.m., the complainant Nikhil Nandkumar Shete was travelling with his family in a Creta car. When they reached in front of a Multi-specialist hospital at Bhosari, an auto rickshaw bearing registration No. MH-14 GC-9127 hit their car from behind. The complainant got down from his vehicle and started discussing with the auto driver. At that time, 2 to 3 unknown persons alighted from the said auto. One of them threw chilli powder in the complainant's eyes, another assaulted him with a steel rod, and third person attacked him with a sharp weapon. They also threatened him and then escaped from the spot with by the said auto. In the said incident, the complainant sustained injuries. On the basis of this, an offence came to be registered against unknown persons."

It is the submission of Mr. Phatate, learned Counsel appearing for the Applicant that the Applicant has no role to play in the incident in question. He was merely driving the autorikshaw. He submits that there are no other antecedents against the

Applicant. He submits that the Applicant will co-operate with the investigation.

Mr. Mangaonkar, learned APP strongly opposes the Anticipatory Bail Application. He submits that the Applicant is not involved in the crime.

Perusal of the record shows that prima facie the Applicant is involved in the crime as even the number plate of the autorikshaw was covered by paper. However, the Applicant is young boy of 21 years old. The injuries are simple in nature. There are no antecedents against the Applicant.

Accordingly, in the facts and circumstances, the case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:

O R D E R

(a) In the event of arrest of the Applicant-Aditya Ambadas Shinde in connection with C.R. No.169 of 2025 registered with the Bhosari Police Station, Pune, the

Applicant is directed to be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the Bhosari Police Station, Pune, on every Sunday between 11:00 a.m. to 01:00 p.m. till filing of the charge-sheet and shall cooperate with the investigation. In addition, the Applicant shall attend the concerned Police Station as and when called.

(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.

(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.

(e) The Applicant shall not tamper with the prosecution

evidence and shall not contact or influence the Complainant or any witness in any manner.

(f) The Applicant shall not leave India without prior permission of the Court.
