Apprehending the arrest in connection with Crime No.732/2025 registered with Police Station, Katol, District Nagpur for the offences punishable under Sections 406, 409 and 420 read with Section 34 of the Indian Penal Code (for short, "IPC"), the applicant/accused no.8 has approached this Court.

The learned counsel for the applicant has submitted that allegations made in the First Information Report if perused it would reveal that the present applicant was working as "Sangh Manager" with Bharat Financial Inclusion Ltd. Katol Branch and he has collected amount of 3,09,024/- in between 06.04.2024 till 07.11.2024 from 10 persons/customers but did not deposit the same with the said company. He further submitted that on 17.03.2026 this Court has granted interim anticipatory bail and recorded the statement of the present applicant that he will deposit remaining amount of 1,30,072/- within ten days.

According to the learned counsel for the applicant out of defalcated amount of 3,09,024/- already amount of 1,78,952/- was deposited. He submitted that as on date the applicant has deposited the entire amount and therefore the applicant be released on bail.

The learned APP has fairly stated that in connected Criminal Application (ABA) no.201/2026 this Court on 01.04.2026 has granted anticipatory bail to the accused similarly circumstanced. She submits that since the entire amount has been deposited, the same course can be followed here.

It is not in dispute that allegation against present applicant was that he had collected amount of 3,09,024/- from the depositors but did not deposit it with the Bharat Financial Inclusion Ltd. Katol Branch. The said amount is now deposited with the said company, as per order dated 17.03.2026. In view of order dated 01.04.2026 passed by this Court in connected matter i.e. ABA No.201/2026 and considering the fact that the applicant has deposited the amount, I am inclined to allow the present application. Accordingly, following order is passed:

ORDER

(i) The application is allowed and disposed of.

(ii) In the event of arrest in connection with Crime No.732/2025 registered with Police Station, Katol, District Nagpur for the offences punishable under Sections 406, 409 and 420 read with Section 34 of the Indian Penal Code , applicant - Rohit S/o Ramkrushna Gudange shall be released on bail on furnishing a PR bond of 25,000/- [Rupees Twenty Five Thousand only] with one solvent surety in the like amount.

(iii) The applicant shall attend the concerned Police Station as and when called by the investigating officer, till filing of the charge-sheet.

(iv) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly.

(v) The applicant shall not leave India without prior permission of this Court.
