The applicant is apprehending his arrest in connection with Crime No.582/2025 registered with Police Station, Khadan, Akola for the offence punishable under Sections 351(2), 311, 128(c), 119 (2), 127(2)(7), 111(1) (2), 2(b) (3) (4) of the Bhartiya Nyaya Sanhita, 2023. 2.

Issue notice to the non-applicant, returnable on 04.03.2026.

Shri Autkar, learned APP waives service of notice on behalf of non-applicant/State and prays for time to file reply.

The contention is that the other co-accused have already been released on bail. The charge-sheet has already been filed. The dispute was in respect of refunding the amount of purchase price of snacks which was being sold by the complainant. On this count, the alleged quarrel took place.

Considering the submissions, more particularly the reason why the quarrel took place, a case is made out for ad interim protection. Hence, the following order: (i) Pending the application, in the event of arrest, in connection with Crime No.582/2025 registered with Police Station, Khadan, Akola for the offence punishable under Sections 351(2), 311, 128(c), 119 (2), 127(2)(7), 111(1) (2), 2(b) (3) (4) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Sachin s/o Mukund Balkhande, be released on bail on executing a PR bond of 25,000/- with one solvent ₹ surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on every Tuesday and Friday between 10.00 am to 02.00 pm for the next two weeks and cooperate with the investigating authority.

(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
