The Applicants are apprehending arrest in connection with Crime No. 568/2025 registered with Police Station, Akkalkot Uttur, Dist. Solapur Rural for the offences punishable under Sections 74, 76, 118(1), 115(2), 351(2), 352, 189(2), 191(2) and 190 of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 and 12 of Protection of Children from Sexual Offences Act, 2012.

Heard the learned counsel for the Applicants, and learned APP for the non applicant-State.

Having gone through the case diary, it appears that the Applicants along with the other co-accused had been to the house of the Complainant where they abused the Complainant and her family members and also assaulted her sister-in-law, mother-in-law and son by means of kick blows, using stone and stick, whereby the Complainant and her family members sustained injuries. On the complaint of the Complainant, the aforesaid offence came to be registered against the Applicants.

The nexus of the dispute is alleged to be the incident of outraging the modesty of the daughter of the Complainant by co-accused Hanmant Chandar Jadhav. The brothers and relatives of Applicants went to the house of the Complainant and abused and assaulted them. 5.
It appears that there is no allegation of outraging the modesty of the victim a minor girl against the present Applicants. There is a delay of 3 days in lodging the FIR. Injuries caused to the present Complainant appear to be simple in nature.

The Applicants were protected by interim order dated 12.03.2026. So far as the anxiety of the learned APP regarding recovery of the weapon is concerned, I think the Applicants can be put to stringent condition.

Considering the role assigned to the present Applicants and the punishment prescribed for the alleged role played by the Applicants, a case is made out for confirmation of the interim order dated 12.03.2026 Hence this order :
I.
Application is allowed.
II.
The interim order dated 16.02.2026 is hereby confirmed. III.
Applicants Vinod Chandar Jadhav, Krushna Chandar Jadhav, Vilas Chandar Jadhav and Dilip Hanmant Jadhav shall appear before the concerned police station on Friday and Tuesday between 10.00 to 12.00 and co-operate in the investigation.
IV.
Appearance before the Investigating Officer shall be treated as custody within the meaning of Section 23 of the Bharatiya Sakshya Adhiniyam, 2023.
