The applicant is apprehending his arrest in connection with Crime No.0065/2026 registered with Police Station, Balapur, District Akola for the offences punishable under Sections 74, 75, 296, 115(2) and 351(2) of the Bhartiya Nyaya Sanhita, 2023.

The contention of the applicant is that there is a dispute between the complainant and the applicant over outstanding dues towards the applicant and therefore, he has been falsely implicated in the crime.

Perusal of the FIR reveals that the applicant allegedly grabbed the neck of the complainant, caught hold of her hand with bad intentions and also hurled abuses at her. 4.
Issue notice to the non-applicant, returnable on 04.03.2026.

Shri Lokhande, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply.

Case diary is not available at present. Considering the submissions and the nature of allegations, the applicant can be granted ad interim protection. Hence, the following order:
ORDER
(i) Pending the application, in the event of arrest in connection with Crime No.0065/2026 registered with Police Station, Balapur, District Akola for the offences punishable under Sections 74, 75, 296, 115(2) and 351(2) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Swapnil S/o Dinkar Gawai be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount. (ii) The applicant shall attend the concerned Police Station on 24th & 27th February 2026 between 10.00 am to 12.00 noon and cooperate with the investigating authority. (iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
