DATED :- 12.03.2026 The applicant seeks anticipatory bail in connection with Crime No. 22/2026 registered with Police Station Khamgaon Gramin, District Buldhana for the offences punishable under Section 303(2) of the Bhartiya Nyaya Sanhita, 2023 r/w. Sections 21(1), 21(2) of the Mines and Minerals (Regulation and Development) Act, 1957.

Heard the learned counsel for the applicant as well as the learned APP for the State. I have gone through the case-diary.

It appears that a raid was conducted on 21.01.2026 and a heap of minor mineral- 'Murum' which was found in front of the house of the applicant came to be seized . It is alleged that it was transported without a valid transit pass and therefore, theft of minor mineral RR Jaiswal

2 65-aba-127-26.odt was committed by the applicant. On the complaint of the Revenue Officer, the aforesaid offence came to be registered against the applicant.

It appears that the minor mineral has already been seized and nothing is required to be seized from the applicant. Whether the minor mineral belongs to the applicant or the applicant stole or transported the minor mineral without having a valid transit pass is a matter of trial.

The applicant was protected by ad-interim order of this Court dated 16.02.2026 and she was directed to appear before the concerned Police Station. The applicant has attended the concerned Police Station and co-operated in the investigation.

Considering these aspects, a case is made out for confirming the ad-interim protection granted to the applicant. Hence, the following order:- i) The application is allowed.

ii) The order dated 16.02.2026 granting adinterim protection to the applicant is hereby confirmed on the same terms and conditions.
