The applicant is apprehending his arrest in connection with Crime No.0276/2025 registered with Police Station, Sonegaon, Nagpur for the offences punishable under Sections 318(4), 319(2), 336(2), 336(3), 338, 340 (2), 61(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023. 2.

The submission of the applicant is that it is a case of sale-deed by impersonation. Main accused Sunil Ajabrao Jivtode sold the said plot to Amol Prabhakar Joshi. The contention of the learned counsel for the applicant is that applicant is the purchaser of the said property. According to the applicant, he is the victim of the said agreement and he was not aware that the property belongs to the complainant. The consideration amount for purchasing the said plot was taken from the IDFC Bank as loan and the applicant is still paying the said loan.

Issue notice to the non-applicant, returnable on 09.03.2026.

Ms Kavimandan, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply.

Case diary is not available at present. Considering the submissions and the nature of allegations, the applicant can be granted ad interim protection. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No.0276/2025 registered with Police Station, Sonegaon, Nagpur for the offences punishable under Sections 318(4), 319(2), 336(2), 336(3), 338, 340 (2), 61(2), 3(5) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Mohammad Salim Khan S/o Mohammad Munnawar Khan be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on every Tuesday and Friday between 10.00 am to 12.00 noon for next two weeks and cooperate with the investigating authority.

(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
