Heard the learned counsel for the applicant and learned APP for non-applicant/State. I have gone through the record. 2.

The applicant is seeking anticipatory bail in connection with Crime No. 43/2026, registered with Police Station, Umarkhed, Dist. Yavatmal, for offences punishable under Sections 132, 121 and 352 of the Bharatiya Nyaya Sanhita, 2023. 3.

Perusal of the case diary reveals that on the day of the incident, the applicant had an altercation with the complainant on account of non availability of network for two hours. During the altercation, the applicant assaulted the complainant who was responsible for working of the network by means of fist blows due to which, the complainant sustained grievous injury on his eyes. Therefore, on the complaint of the complainant, the aforesaid offences came to be registered.

It is to be noted that none of the offences are punishable with imprisonment for more than five years. The applicant was

74aba137.2026..odt protected by way of ad interim order with a direction to attend the concerned police station. Accordingly, the applicant has attended the police station and cooperated in the investigation. 5.

Considering the nature of offence, the punishment provided and the fact that nothing is required to be seized from the applicant, a case is made out for confirmation of the interim order. Hence, following order:

i) The order dated 18.2.2026 is hereby confirmed on the same conditions, except condition No. 7(ii).

ii) The applicant shall appear before the concerned Police Station as and when directed by the Investigating Officer. iii) The applicant shall not indulge in similar type of offence and shall not tamper with the prosecution evidence or threaten the prosecution witnesses. JUDGE Belkhede PS
