Apprehending the arrest in connection with Crime No.419/2024 registered with Police Station, Chimur, District Chandrapur for the offences punishable under Sections 184 of the Motor Vehicles Act, 1988, Section 11(1)(d), 11(1)(e) of the Prevention of Cruelty to Animals Act, 1960, Sections 5A, 9A of the Maharashtra Animal Prevention Act, 1976 read with Section 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023, the applicant/accused no.4 has approached this Court. 2.
In short, it is the case of the prosecution in the First Information Report that cattles were transported in a vehicle without any permission. So far as present applicant is concerned, it was alleged that he was present in a Bolero vehicle which was piloting the container wherein cattle were being transported in cruel manner and the container was overloaded.

The learned counsel for the applicant has submitted that the allegations made against the applicant are totally vague and he was not even present on the spot. According to him, this Court on 26.02.2026, has granted him interim anticipatory bail and directed to attend the concerned police station, which he attended. He further submitted that maximum punishment prescribed for the offences registered though life imprisonment but record of the case would reveal that the ingredients of Section 108 of the BNS are not made out. He further submitted that so far as other offences are concerned they are punishable upto five years.

Be that as it may, the First Information Report shows that the present applicant was piloting the container and was neither the owner of the vehicle nor the owner of cattle. Since, the applicant has attended the police station as directed by this Court vide order dated 26.02.2026 and considering the stage of investigation, I am inclined to pass the following order.

So far as contention of the learned APP that the vehicle which was carrying the cattle was transferred in favour of some other person and details of which are not disclosed by the present applicant, suffice it to say that it is not even the case of the prosecution that the applicant was owner either of the cattle or the vehicle. In that view of the matter, the following order is passed:
ORDER
(i) The application is allowed and disposed of.
(ii) In the event of arrest in connection with Crime No.419/2024 registered with Police Station, Chimur, District Chandrapur for the offences punishable under Sections 184 of the Motor Vehicles Act, 1988, Section 11(1)(d), 11(1)(e) of the Prevention of Cruelty to Animals Act, 1960, Section 5A, 9A of the Maharashtra Animal Prevention Act, 1976 read with Section 109, 3(5) of the Bharatiya Nyaya Sanhita, 2023, applicant - Arbaz Khan Saleem Khan Qureshi shall be released on bail on furnishing a PR bond of 55,000/- ₹ [Rupees Fifty Five Thousand only] with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned Police Station on 25th and 26th April 2026 between 12.00 noon to 03.00 pm.
(iv) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly.
(v) The applicant shall not leave India without prior permission of this Court.
