5.

It is submitted that the applicant had obtained a tender for construction of canal between 85 and 86 Kilometer from Chopdi Irrigation Department, Dist. Yavatmal. The allegation is that in the process of procuring the said tender, the applicant had submitted a forged experience certificate showing that similar work was earlier conducted by the applicant.

2 40 aba161.26.odt 6.

The contention is that just because the Department whose experience certificate was annexed by the applicant, issued a letter to the Enquiry Officer that they do not possess the said document for the reason that is very old, the Enquiry Officer got registered an offence against the applicant. The further contention is that the applicant aged about 78 years is bed ridden . 7.

Considering the submissions and the fact that the case-diary is necessary for perusal which is not available at this juncture, a case is made out for grant of ad-interim protection to the applicant.
