Heard the learned counsel appearing on behalf of the Applicants and the learned APP for the Respondent-State.

The Applicants seek anticipatory bail in connection with Crime No. 0023 of 2026, registered with Chandgad Police Station, Kolhapur, for offences punishable under Sections 109, 118(1), 115(2), 352, 351(3), and 3(5) of the Bharatiya Nyaya Sanhita, 2023. I have perused the case diary. 3.

It appears that the incident occurred on 09.02.2026 when the complainant along with his father, was proceeding towards their village.

An altercation took place between the Applicants and the main accused Ajit Parashram Rembulkar on account of a dispute while overtaking the vehicles. When the main accused alighted from the vehicle, he assaulted the complainant by means of an iron rod, causing injuries to his right hand and right leg. Applicant No. 1-Parashram also assaulted the complainant by means of fist blows and abused him. Thereafter, when the complainant along with his father, went to the house of the Applicants, main accused-Ajit, again assaulted the brother-in-law of the complainant on his back. The present Applicants also assaulted him by means of fist and kick blows. 4.

It appears that main accused Ajit Rembulkar has already been arrested. No assault by means of any weapon is attributed to the present Applicants. Whether the Applicants shared common intention is a matter of trial. Considering the nature of allegations against the Applicants, no custodial interrogation is required.

In view of the above, and considering the role attributed to the present Applicants, a case is made out for confirmation of the ad-interim relief granted by this Court by order dated 02.04.2026. Hence, the following order is passed:

ORDER

(a) Anticipatory Bail Application is allowed.

(b) In the event of arrest in connection with Crime No. 0023 of 2026 registered with Chandgad Police Station, Kolhapur for the aforesaid offences, the Applicants-Parashram Mhatru Rembulkar and Dipak Parashram Rembulkar be released on bail upon furnishing a P.R. bond of 50,000/- each with one solvent surety ₹ each in the like amount.

(c) The Applicants shall attend the concerned police station every Saturday and Tuesday between 10:00 a.m. and 12:00 noon for a period of two weeks.

(d) The Applicants shall not tamper with the prosecution evidence or threaten the prosecution witnesses and shall cooperate in the investigation.

(e) The appearance of the Applicants before the concerned Investigating Officer shall be treated as custody within the meaning of Section 23 of the Bhartiya Sakshya Adhiniyam. Digitally signed by TALLE SHUBHAM ASHOKRAO Date:
