Heard Mr. Ghorpade, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP for the RespondentState of Maharashtra. 2.
By the present Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.491 of 2024 registered with the Bhosari M.I.D.C. Police Station, PimpriChinchwad, Pune, for the offences punishable under Sections 318(4) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It is the submission of Mr. Ghorpade, learned Counsel for the Applicant that, without accepting the prosecution case the Applicant will deposit an amount of Rs.1,00,000/- before the learned Trial Court within a period of 2 weeks from today. He submits that the Charge-sheet is already filed and that there are no antecedents against the Applicant. He, therefore, submits that the Anticipatory Bail Application be allowed.

On the other hand, Mr. Mangaonkar, learned APP, submits that the offence is very serious and, therefore, custodial interrogation is necessary. However, on instructions, he submits that the Charge-sheet is already filed and there are no other criminal antecedents against the Applicant.

Mr. Mangaonkar, learned APP, submits that if the Court is inclined to grant anticipatory bail, the Applicant be directed to attend the Police Station, as Police are further investigating the crime.

The prosecution case is set out in paragraph no.3 of the order dated 18th December 2025 passed by the learned Additional
Sessions Judge, Pune in Criminal Bail Application No. 7798 of 2025, which reads as under: - "3] The case of the prosecution in short is that accused persons in furtherance of their common intention cheated the informant and other six persons for the amount of Rs. 3,59,000/- under the pretext of offer to travel for 35 days in all India within five years. The accused persons have cheated the informant and others under the name of 'Brandemirates Pvt.Ltd. Tours and Travels Company'. The informant Kiran Ramrao Balure lodged report about the same. On the basis of his report, CR No. 491/2024 came to be registered with MIDC Bhosari Police Station." 7.
As the Charge-sheet is filed, investigation is completed. A Co-Accused being Accused No.5-Mayur Dattatray Thange has already been granted anticipatory bail by Order dated 3rd December 2025 passed by this Court.

Accordingly, in the facts and circumstances, the case is made out for grant of anticipatory bail.

In view thereof, the following Order is passed:
O R D E R
(a) In the event of arrest of the Applicant - Janardan Dnyaneshwar Parave, in connection with CR No.491
of 2024 registered with the Bhosari M.I.D.C. Police Station, Pimpri-Chinchwad, Pune, be released on bail on his furnishing PR Bond in the sum of Rs.50,000/- with one or two solvent sureties in the like amount. (b) The Applicant shall attend the concerned Police Station on 31st January 2026 and 1st February 2026 between 11:00 am to 02:00 pm and thereafter as and when necessary and shall cooperate with the investigation.
(c) The Applicant shall furnish his cell phone number and residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto.
(d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel.
(e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the
Complainant or any witness in any manner.
(f) The Applicant shall not leave India without prior permission of the Court.
(g) The voluntary statement of the Applicant is accepted that the Applicant will deposit before the learned Trial Court an amount of Rs.1,00,000/- within a period of 2 weeks from today.
