These applications are filed by the accused who are not named in the FIR No. 222/2026, dated 14.02.2026, registered with Police Station, Umred, Nagpur Rural, for the offences punishable under Sections 109(2)118(2), 132, 324(3), 324(5), 326(F), 189(2), 352of the Bharatiya Nyaya Sanhita, 2023.

In Criminal Application (ABA) No. 183/2026, the applicants are Bhupati Ramesh Kilnake and Dhiraj Sangharatna Mandaokar and in Criminal Application (ABA) No. 179/2026, Pranit Vijay Bhiwankar is the applicant.

The reporter of the crime is the Police Constable attached to the Traffic Department of Umred Police Station.

In short, it is the case of the informant that on 12.2.2026, he received information that an incident had taken place near MIDC Fly Over, mouza Mohpa, and that the dead body of the deceased was lying on the road. Nearby villagers/mob gathered there and chased the offending vehicle i.e. Tipper. Mob then assaulted the driver of the offending vehicle and also set the vehicle on fire. When police reached the spot of the incident, they took the driver of offending vehicle into custody but at that time, police vehicle was obstructed and damage was caused to it. With the help of other persons, the driver of the offending vehicle was taken out and then referred for medical examination. The damage caused to the public property also resulted into invocation of offences punishable under Sections 3 and 4 of the Prevention of Damage to Public Property Act.

The learned counsel for the applicant has argued that the applicants were only bystanders and did not participate in the incident.

The learned APP has fairly submitted that none of the eye witnesses and the CCTV footage, shows that the applicants participated in damaging the Government property participated in any overt-act.
Considering the aforesaid facts, the following order is passed:
ORDER
3 14aba183.2026..odt i) The applications are allowed and disposed of. ii) In the event of arrest in connection with Crime No. 222/2026, dated 14.02.2026, registered with Police Station, Umred, Nagpur Rural, for the offences punishable under Sections 109(2)118(2), 132, 324(3), 324(5), 326(F), 189(2), 352of the Bharatiya Nyaya Sanhita, 2023, the applicants be released on bail on furnishing a P.R. bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) each with one solvent surety in the like amount. iii) The applicants shall attend the Police Station, as and when directed and shall cooperate with the investigating agency.
iv) The applicant shall not tamper with the prosecution evidence or threaten the prosecution witnesses.
v) The applicant shall not leave the India without prior permission of the Court.
