The Applicant is apprehending arrest in connection with Crime No.14 of 2026 registered with Hupri Police Station, District Kolhapur for the offence punishable under Section 108 of the Bhartiya Nyaya Sanhita, 2023. 2.

Heard the learned counsel for the applicant and the learned A.P.P, for non applicant - State. I have gone through the case diary. 3.

The First Information Report reveals that deceased Divya committed suicide on 22nd December, 2025. Subsequently, it came to the knowledge of

the complainant, who is the brother of the deceased that the applicant who was already married, was in a love relationship with the deceased. It is further alleged that the applicant was insisting that the deceased shall procure and show photographs of herself with her former partner as a precondition of getting married, after getting a divorce from his wife. 4.

The First Information Report discloses that the deceased had visited coaccused Akash Chavan, her former partner for the purpose of obtaining the photographs. It is alleged that he had refused to hand over the photographs of the deceased, which were stored in his mobile phone which were taken during the subsistence of their relationship and therefore the deceased committed suicide.

It appears that the co-accused, despite being requested, did not furnish the photographs available in his mobile phone to the deceased. It is the coaccused who is alleged to have threatened to circulate those photographs. Whether the act of the applicant asking the deceased to bring the old photographs with the former partner as a precondition for marriage after obtaining a divorce from his wife amounts to abetment of suicide is a matter of trial. Nothing is required to be seized from the present applicant.

Considering the nature of allegations against the present applicant, as well as the fact that custodial interrogation of the applicant is not necessary; in my view, a case is made out for grant of anticipatory bail. Hence, the following order:

(i) The Application is allowed.

(ii) In the event of arrest of Applicant - Aniket Adgonda Patil in connection with Crime No.14 of 2026 registered with Hupri Police Station, District Kolhapur for the offence punishable under Section 108 of the Bhartiya Nyaya Sanhita, 2023, he shall be released on bail upon furnishing a PR bond in the sum of Rs.50,000/- with one solvent surety in the like amount. (iii) The applicant shall attend the concerned police station on every Friday and Tuesday between 10.00 a.m and 12.00 noon till filing of the charge-sheet and shall co-operate in the investigation. (iv) The Applicant shall not tamper with the prosecution evidence and shall not pressurize or influence the prosecution witnesses in any manner. 7.
