Apprehending arrest in connection with Crime No.37/2026 registered with Police Station, Dhad, District Buldhana for the offences punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, the applicant / sole accused has approached this Court.

Reporter of crime is one Mangla Ranganath Shinde. The applicant is sole accused, a woman, in the First Information Report. The reporter of crime had a son, by name Rohit. Rohit was having love affair with the present applicant. The applicant was married but Rohit was not married. According to the First Information Report, the informant and her husband were aware about the fact that said Rohit and the applicant used to talk with each other on telephone and had a love affair. It was further alleged in the First Information Report that the applicant was in need of amount of 25,000/- and therefore requested Rohit for help. Said Rohit then asked the informant/his mother to provide
amount of 25,000/- which the informant, gave to Rohit. It was alleged in the First Information Report that by way of various online transactions on different dates the total amount of 25,000/- was paid to the applicant by said Rohit.

It was further alleged that when informant asked the applicant about repayment of the amount, she told that her mother would repay the said amount. According to the First Information Report, on several occasions amount was demanded by Rohit, which was not paid by the applicant. The applicant instead of paying the amount, threatened the informant that she would kill herself. It is due to this reason, Rohit used to remain under continuous mental tension and ultimately committed suicide by hanging on 26.12.2025. This information resulted into registration of First Information Report dated 04.02.2026.

The learned counsel for the applicant has contended that the ingredients of the offences are not made out and therefore anticipatory bail be granted to the applicant. He further contended that as per the order passed by this Court, the applicant has already attended the police station. 5.
Per contra, the learned APP has contended that there were specific allegations against the present applicant that said Rohit was continuously harassed by the present applicant and even the amount was not repaid. She prayed for rejection of bail application.

With the help of the respective counsels, I have gone through the record of the case. The First Information Report shows that the applicant was having love affair with said Rohit. It has also come on record that the amount of 25,000/- was given by the mother of said Rohit to the applicant which was not repaid. The record shows that when a request was made to the applicant for repayment of the amount, she threatened Rohit to commit suicide. It is in this background due to harassment, alleged in the First Information Report, that Rohit has committed suicide. It is clear that the material collected during course of investigation is not enough to show that it was the present applicant who has abated the suicide.

Since, the applicant has attended the police station and a prima facie case is made out by her, following order is passed:
ORDER
(i) The application is allowed and disposed of.
(ii) In the event of arrest in connection with Crime No.37/2026 registered with Police Station, Dhad, District Buldhana for the offences punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, applicant - Sau. Varsha w/o Umesh Nikam shall be released on bail on furnishing a PR bond of 25,000/- [Rupees Twenty Five Thousand only] with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned Police Station as and when called by the investigating officer, till filing of the charge-sheet.
(iv) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. (v) The applicant shall not leave India without prior permission of this Court.
