This is an application for Anticipatory Bail. 2.

The applicant is apprehending his arrest in Crime No. 722 of 2025 registered at Kalyan Taluka Police Station, for the offences punishable under Sections 118(1), 189(1), 189(2), 191(2) & 190 of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on the date of incident, which took place on 19.12.2025 at around 3.00 pm., when the first informant was going on his motorcycle, he was stopped as he was allegedly driving the motorcycle in rash and negligent manner. It is alleged that the present applicant and 1/3

other co-accused thereafter assaulted the first informant by fist and kick blows and by iron pipe.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The learned counsel for the applicant submits that the alleged assault by iron pipe is not attributed to the present applicant. It is submitted that there is a delay of six days in lodging the FIR. The learned counsel for the applicant, on instructions, submits that the applicant, without prejudice to his rights and contentions, is willing to pay Rs.20,000/- to the first informant towards medical expenses. It is submitted that there are no other criminal antecedents against the present applicant. 6.

On the other hand, the learned APP for the respondentState submits that the applicant was part of unlawful assembly. It is submitted that the present applicant has assaulted the first informant by fist and kick blows.

I have perused the First Information Report. The assault by iron pipe is not attributed to the present applicant. There are no other criminal antecedents against the applicant. Considering 2/3

the overall facts and circumstances of the case, I am inclined to release the applicant on anticipatory bail. In the result, the following order is passed :

O R D E R

a) The Application is allowed.

b) In the event of arrest of the applicant in connection with Crime No. 722 of 2025 registered at Kalyan Taluka Police Station, for the offences punishable under Sections 118(1), 189(1), 189(2), 191(2) & 190 of the Bharatiya Nyaya Sanhita, 2023, the applicant be released on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

c) The applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation.

d) The applicant shall hand over the demand draft of Rs.20,000/- in the name of first informant to the investigation officer within a period of four weeks, who in turn shall hand over the said demand draft to the first informant.

e) The application is disposed of in the aforesaid terms.
