Apprehending arrest in connection with Crime No.02/2026 registered with Police Station, Sadar, Nagpur for the offence punishable under Section 316(5) of the Bharatiya Nyaya Sanhita, 2023, the applicant / sole accused has approached this Court.

Reporter is one Ratnesh Suresh Mahoria. The applicant is wife of the reporter. The applicant was working on the post of Branch Manager with Bank of Maharashtra. It was further alleged that the informer had bank account with Itwari Branch and the mobile number which was linked with the account was changed at the behest of the present applicant and finally through that sum of 30,12,849/- was transferred in her account. It is in this background, the First Information Report came to be registered.

The learned counsel for the applicant has submitted that the dispute is between the husband and wife. The husband by narrating the false story has lodged the First Information Report. He submitted that the amount of 32 lakhs was not credited in her account.

Per contra, the learned APP has submitted that though on two different occasions amount of 14 lakhs is credited but investigation is required to be done to ascertain purpose for transfer.

Th learned counsel for the applicant has submitted that her salary account is already freezed and the investigation can proceed without her custody. He has further submitted that the applicant has attended the police station as directed by this Court, which is not disputed by the learned APP.

Considering the fact that the applicant is the wife of the informant and the account is already freezed, so also the statement made by the learned APP that the investigation is on the verge of completion, I am inclined to pass the following order:

ORDER

(i) The application is allowed and disposed of.

(ii) In the event of arrest in connection with Crime

No.02/2026 registered with Police Station, Sadar, Nagpur for the offence punishable under Section 316(5) of the Bharatiya Nyaya Sanhita, 2023, applicant - Shruti Ratnesh Mahoriya @ Shruti Liladhar Borkar shall be released on bail on furnishing a PR bond of 55,000/- [Rupees Fifty Five Thousand only] with one solvent surety in the like amount. (iii) The applicant shall attend the concerned Police Station as and when called by the investigating officer, till filing of the charge-sheet.

(iv) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. (v) The applicant shall not leave India without prior permission of this Court.
