The applicants are seeking anticipatory bail in connection with Crime No. 0148/2026, registered with Police Station, Durgapur, Tal. and Dist Chandrapur, for the offences punishable under Sections 406, 409 and 420 read with Section 34 of Indian Penal Code read with Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 and Sections 21,22 and 23 of the Banning of Unregulated Deposit Schemes Act, 2019.

Learned APP waives notice on behalf of non-applicant/State.

The allegation against the applicants is that they were operating the business of illegal Bhisi transaction. It appears that various persons contributed to the Bhisi. There are allegations of

inducement against the applicants. Shri Kothari, who was the main coordinator, could not manage the account properly and could not return the amount to the beneficiaries, however, his name has not been implicated in this crime.

Considering the submission, perusal of the case diary is necessary which is not available today. So also, affidavit in reply of the State is not on record. In this view of the matter, a case is made out for grant of ad interim protection. Hence, following order is passed:

i) Pending the application, in the event of arrest of applicants, namely Mohammad Matin s/o Abdul Majid Sheikh and Farhat w/o Mohammad Matim Sheikh, in connection with Crime No. 0148/2026, registered with Police Station, Durgapur, Tal. and Dist Chandrapur, for the offences punishable under Sections 406, 409 and 420 read with Section 34 of Indian Penal Code read with Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 and Sections 21,22 and 23 of the Banning of Unregulated Deposit Schemes Act, 2019 shall be released on bail on furnishing a PR bond of Rs.25,000/- each with one solvent surety each in the like amount.

ii) The applicants shall attend the concerned Police Station on every Friday and Tuesday between 10.00 am and 12.00 noon for a period of two weeks and shall cooperate in the investigation.

iii) The applicants shall not indulge in tampering with the

prosecution evidence and shall not pressurize the prosecution witnesses in any manner.
