Heard the learned counsel for the applicant and learned App for non-applicant/State.

The applicant is seeking anticipatory bail in connection with Crime No. 38/2026, registered with Police Station, Yavatmal City, Tah. Dist. Yavatmal for the offence punishable under Sections 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Issue notice to the non applicant, returnable on 6.4.2026.

Learned APP waives notice on behalf of nonapplicant/State. 5.

The contention is that the accused, who assaulted the victim/injured is already arrested. The allegation against the applicant is that he aided the accused persons by

53aba205.2026..odt providing his car. Name of the applicant does not appear in the First Information Report. To scrutinize the material against the applicant, perusal of the case diary is necessary, which is not before the Court today.

Considering the submissions and the fact that the case diary is not available for perusal, a case is made out for grant of ad interim relief. Hence, following order is passed: i) Pending the application, in the event of arrest of applicant- Shaikh Israil Shaikh Ismail, in connection with Crime No. 38/2026, registered with Police Station, Yavatmal City, Tah. Dist. Yavatmal for the offence punishable under Sections 109(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR bond of Rs. 25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station on every Friday and Tuesday between 10.00 am and 12.00 noon for a period of two weeks and shall cooperate in the investigation.

iii) The applicant shall not indulge in tampering with the prosecution evidence and shall not pressurize the prosecution witnesses in any manner.
