Heard the learned counsel appearing on behalf of the applicant.

Issue notice to the non-applicant/State, returnable on 08.04.2026.

Learned APP waives service of notice on behalf of the non-applicant/State.

The applicant is apprehending arrest in connection with Crime No. 59/2026 registered with Police Station, Allipur, Dist. Wardha for the offences punishable under Sections 118(1), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

It appears that the agricultural fields of the applicant and the complainant are adjacent to each other. It appears that there was a dispute between them over the right of way.

The allegation against the applicant is that on 11.2.2026, a quarrel took place between the father of the complainant and the applicant wherein, the applicant

2 42 aba209.26.odt assaulted the complainant and his father. It appears that the applicant also received some injuries and also lodged a counter report about the same incident, which was registered as a non-cognizable report.

Considering the submissions and the fact that the case-diary is not available with the Court for perusal at this juncture, a case is made out for grant of ad-interim protection to the applicant. Hence, the following Order : i) Pending the application, in the event of arrest of applicant- Sharad Damodhar Surkar in connection with Crime No. 59/2026 registered with Police Station, Allipur, Dist. Wardha for the offences punishable under Sections 118(1), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station on every Friday and Tuesday between 10.00 am and 12.00 noon for a period of three weeks and shall cooperate in the investigation. iii) The applicant shall not indulge in tampering with the prosecution evidence and shall not pressurize the prosecution witnesses in any manner.
