The applicant is apprehending his arrest in connection with Crime No.95/2026 registered with Police Station, Anjangaon, District Amravati for the offences punishable under Sections 316(5), 318(3), 318(4), 61(2)(a) of the Bhartiya Nyaya Sanhita, 2023 and Section 5, 7 and 8 of the Maharashtra Prevention of Malpractices at University, Board and other specified Examinations Act, 1982. 2.

Issue notice to the non-applicant, returnable on 06.04.2026.

Ms Sapkal, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply. 4.

It appears that the applicant appears to be the father of the ward who appeared in the 10th Board Examination. It appears that when the Flying Squad conducted inspection at DC-28 at Anjangaon Surji, two answer sheets of English and Urdu each were missing which were found in the custody

of another person. The said answer sheets belongs to the ward of the applicant.

It is contended that the ward of the applicant has been taken into custody by the Juvenile Board and now, the applicant is being called in the police station. 6.

Perusal of the FIR does not reveal the name of the applicant. Moreover, no role has been assigned to the applicant in the FIR.

Learned APP submits that the Call Details Report (CDR) of the applicant and accused no.2 have been called. 8.

Considering the submissions, detailed scrutiny of the case diary is necessary, which is not available at present. Reply of the State is yet to be filed on record. In the meanwhile, the applicant can be granted ad interim protection. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No.95/2026 registered with Police Station, Anjangaon, District Amravati for the offences punishable under Sections 316(5), 318(3), 318(4), 61(2)(a) of the Bhartiya Nyaya Sanhita, 2023 and Section 5, 7 and 8 of the Maharashtra Prevention of Malpractices at University, Board and other specified Examinations Act, 1982, the

applicant - Muzammil Ali Maksud Ali be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on every Friday and Tuesday between 10.00 am to 12.00 noon for two weeks and cooperate with the investigating authority.

(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
