The applicant is apprehending arrest in connection with Crime No.297 of 2025 registered with Barshi Taluka Police Station, District Solapur for the offences punishable under Sections 109 (1), 115 (2), 189 (2), 189 (4), 190, 191 (3), 351 (3), 352 of the Bhartiya Nyaya Sanhita, 2023. 2.
Heard the learned counsel for the applicant and the learned A.P.P for the non-applicant - State. I have gone through the case diary. 3.
It appears that there is a dispute between Satyawan Bhaskar Hajare and family on one side and Vaman Maruti Hajare and family on the other, on
account of ancestral agricultural land. On 27th September, 2025, the applicant alongwith other co-accused had been to the house of complainant- Satyavan Hajare and called him out of his house. The applicant and other accused abused him in filthy language and when the complainant protested, coaccused - Sagar Vaman Hajare tried to assault the complainant on his head by means of a sharp sickle. However, the complainant sustained bleeding injury on his forehead while trying to save himself. Another co-accused Aadesh Lungse also assaulted the complainant by means of a sickle on the left hand of the complainant and caused bleeding injury. Co-accused Anna Ghalake assaulted the complainant by means of a wooden stick on his thigh and other accused assaulted the complainant by means of fist and kick blows. On the complaint of the complainant, the aforesaid F.I.R came to be registered against the applicant and other co-accused. 4.
It appears that the other co-accused who assaulted the complainant by means of a wooden stick has been granted anticipatory bail by the learned Additional Sessions Judge. It appears from the case diary that no assault by means of any weapon is attributed to the present applicant. Therefore, nothing is required to be seized from the applicant and hence, his custodial interrogation may not be required.

Considering the role assigned to the present applicant, a case is made out for grant of anticipatory bail. Hence, the following order: : O R D E R:
(a) The Anticipatory Bail Application is allowed. (b) In the event of arrest in connection with Crime No.297 of 2025 registered with Barshi Taluka Police Station, District Solapur for the offences punishable under Sections 109 (1), 115 (2), 189 (2), 189 (4), 190, 191 (3), 351 (3), 352 of the Bhartiya Nyaya Sanhita, 2023, applicant - Jyotiram Ramchandra Shinde shall be released on bail upon furnishing a P.R bond in the sum of Rs.15,000/- with one solvent surety in the like amount. (c) The applicant to appear before the concerned Police Station on 04.05.2026, 08.05.2026 and 12.05.2026 and co-operate in the investigation. (d) The applicant shall not threaten the prosecution witnesses or tamper with the prosecution evidence.
