The applicant is apprehending his arrest in connection with Crime No.06/2026 registered with Police Station, Daryapur, District Amravati for the offence punishable under Sections 316(2) of the Bhartiya Nyaya Sanhita, 2023.

The contention of the applicant is that the applicant is the middle man who arranged the marriage between the complainant and her husband. It is submitted that there is marital discord between the complainant and her husband and a dispute related to the ornaments received by the complainant in her marriage is going on between the married couple. It is also contended that the gold ornaments which were provided by the groom were handed over by the complainant to the applicant and accordingly, he handed over the said articles to the groom but since the groom refused to give her the gifts back, the aforesaid complaint has been lodged.

Issue notice to the non-applicant, returnable on 02.04.2026.

Ms Kavimandan, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply.

The allegations against the applicant are that the complainant had handed over the gold ornaments to him while she was traveling with the applicant in a bus. However, the applicant failed to return the same. It appears that the complaint has been lodged after a considerable delay of eight months.

Considering the submissions and the nature of allegations, detailed scrutiny of the case diary is necessary, which is not available at present. In the meanwhile, the applicant can be granted ad interim protection. Hence, the following order:
ORDER
(i) Pending the application, in the event of arrest in connection with Crime No.06/2026 registered with Police Station, Daryapur, District Amravati for the offence punishable under Sections 316(2) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Bhante Rewat Bodhi be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount.
(ii) The applicant shall attend the concerned Police Station on every Friday and Tuesday between 10.00 am to 12.00 noon for two weeks and cooperate with the investigating authority.
(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
