2.

Heard the learned counsel for the applicant as well as the learned APP for the State. I have gone through the case-diary.

3.

It appears that the deceased- Ganesh @ Lakhan Raju Miratkar was working as a Sweeper with Gram Panchayat Sungaon, Tah. Jalgaon Jamod. It is alleged that he found some gold coins. The applicant was insisting for a share in the gold coins and threatened the applicant that if he does not do so the applicant will lodge a false complaint and the deceased will lose his

2 78-aba-214-26.odt service. The applicant is also said to have mentally and physically harassed the deceased. On 19.02.2026, the deceased committed suicide by hanging and on 20.02.2026, the mother of the deceased lodged the police report against the applicant and the aforesaid offence came to be registered.

4.

Perusal of the case-diary does not reveal any specific date of incident on which the alleged harassment was made to the deceased by the applicant. There is no material in the case-diary showing proximity of the alleged threat/harassment by the applicant and the act of committing suicide by the deceased. There is no suicide note left by the deceased. Nothing is required to be seized from the applicant. Whether the applicant abetted the deceased to commit suicide or there was any other reason for the suicide is a matter of trial.

5.

Considering the above-said facts, no custodial interrogation of the applicant may be required. Hence, a case is made out for grant of anticipatory bail to the applicant. Hence, the following order:- i) The application is allowed.
