The applicant seeks anticipatory bail in connection with Crime No. 29/2026 registered with Police Station Benoda, District Amravati for the offence punishable under Section 311 of the Bhartiya Nyaya Sanhita, 2023 (BNS).

Issue notice to the non-applicant, returnable on 08.04.2026.

The learned APP waives service of notice for the non-applicant/State.

The contention is that there is no allegation of dacoity in the First Information Report (FIR) but still, the offence under Section 311 of the BNS has been registered against the applicant.

Perusal of the FIR does not reveal any robbery or extortion by any of the accused persons mentioned in the FIR. Detailed scrutiny of the case-diary and reply of the State is required, which is not available today.

Considering the submission, a case is made out for grant of ad-interim protection to the applicants. Hence, the following order:- i) Pending application, in the event of arrest, applicant- Jayesh S/o. Mohanrao Kale shall be released on bail on furnishing a P.R. bond of Rs.25,000/- with one solvent surety in the like amount in connection with Crime No. 29/2026 registered with Police Station Benoda, District Amravati for the offence punishable under Section 311 of the Bhartiya Nyaya Sanhita, 2023. ii) The applicant shall appear before the concerned Police Station between 10:00 am to 12 noon on every Friday and Tuesday until further orders. iii) The applicant shall not threaten the prosecution witness and shall not tamper with the prosecution evidence and shall co-operate in the investigation.
