The applicant is apprehending his arrest in connection with Crime No.95/2026 registered with Police Station, Anjangaon, District Amravati for the offences punishable under Sections 316(5), 318(3), 318(4), 61(2)(a) of the Bhartiya Nyaya Sanhita, 2023 and Section 5, 7 and 8 of the Maharashtra Prevention of Malpractices at University, Board and other specified Examinations Act, 1982. 2.

Issue notice to the non-applicant, returnable on 06.04.2026.

Shri Autkar, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply. 4.

The contention of the applicant is that the applicant was the Deputy Supervisor of 10th Board Examination Centre DC-28, Anjangaon Surji where the Flying Squad conducted

inspection and found that two answer sheets of English and Urdu each were missing, which were found in the custody of another co-accused. Further contention is that the Supervisor and co-accused in whose custody the said answer sheets were found were arrested and have already been released on bail. The applicant is not involved in concealing the answer-sheets and just because he was the Deputy Supervisor, at the relevant time, his name is mentioned in the FIR.

Considering the submissions, detailed scrutiny of the case diary is necessary, which is not available at present. Reply of the State is also yet to be filed on record. In the meanwhile, the applicant can be granted ad interim protection. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No.95/2026 registered with Police Station, Anjangaon, District Amravati for the offences punishable under Sections 316(5), 318(3), 318(4), 61(2)(a) of the Bhartiya Nyaya Sanhita, 2023 and Section 5, 7 and 8 of the Maharashtra Prevention of Malpractices at University, Board and other specified Examinations Act, 1982, the applicant - Sushilkumar Dadarao Abhyankar be released on bail on furnishing a PR bond of Rs.25,000/- with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on every Thursday and Monday between 10.00 am to 12.00 noon for two weeks and cooperate with the investigating authority.

(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
