Both these applications filed for anticipatory bail are arising out of one and the same crime. They are thus being disposed of by this common order.

The applicants are apprehending their arrest in Crime No.1112 of 2025 registered at Bhiwandi City Police Station, Thane City for the offences punishable under Sections 3(5), 350(1), 115(2) and 118(1) of the Bharatiya Nyaya Sanhita, 2023. 1/3

It is the case of the prosecution that on the date of incident which took place on 20th December 2025, on account of some trivial issue dispute arose between the applicants on one side and the first informant and his friend on other side. It is alleged that during the said dispute, the present applicants assaulted the first informant by iron rod due to which he sustained grievous injuries. 4.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. 5.

Learned counsel for the applicants submits that there is a cross FIR for attempt to murder against the first informant and his friend as they assaulted the applicant - Satyanarayan and the applicant - Chandrakiran. It is submitted that there are no other criminal antecedents against the applicants.

On the other hand, learned APP for the respondent/State submits that considering the nature of crime, the applicants may not be released on anticipatory bail.

I have perused the FIR. Prima facie, the incident does not appear to be premeditated. The fact that there is a cross FIR in relation to the alleged incident is not disputed. There are no other criminal antecedents against the applicants. Considering the overall facts and circumstances of the case, I am inclined to release the applicants on anticipatory bail. In the result, the following order is passed.

ORDER

A) The Applications are allowed.

B) In the event of arrest of the applicants in C.R. No.1112 of 2025 registered at Bhiwandi City Police Station, Thane City for the offences punishable under Sections 3(5), 350(1), 115(2) and 118(1) of the Bharatiya Nyaya Sanhita, 2023, they be released on bail on executing P.R. Bond in the sum of Rs.25,000/- each with one surety or two sureties in the like amount.

C) The applicants shall attend the concerned police station from 2nd February 2026 to 4th February 2026 in between 11.00 a.m. and 2.00 p.m. and shall cooperate in the investigation.

D) The applicants shall not commit any other crime. [N.R.BORKAR, J.] 3/3
