Apprehending arrest in connection with Crime No. 23/2026 registered with Police Station, Nandanvan, District Nagpur, for the offence punishable under section 8(c), 22(c), 20(b)(ii)(a) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the applicant has approached this Court.

The FIR was registered against one Suraj @ Navva Pramod Gajbhiye. In short, it is the case of the prosecution that on the basis of information received about the person dealing with Narcotic Drugs and Psychotropic Substances, the informant along with the raiding party proceeded. It is further alleged that one accused Suraj was apprehended and during his personal search, a plastic bag containing contraband, which was later found to be mephedrone, was seized. It is further alleged in the FIR that Ganja was also found, and when the accused named in the FIR was questioned, he disclosed that the contraband was purchased from the present applicant.

The learned counsel for the applicant has submitted that it is on the basis of statement of the co-accused, the name of the applicant has revealed. He therefore, submitted that he be released on anticipatory bail.

Per contra, the learned APP has opposed the bail application on the ground that not only mephedrone but also ganja was seized from the accused. The learned APP has submitted that except the statement of co-accused, no other incriminating material is available against the applicant.

The learned APP has submitted that there are neither any telephonic calls, nor exchange of money, nor does the applicant have any criminal antecedents. 6.
Heard respective counsels. Record shows that Ganja and mephedrone was recovered from the co-accused. Except statement of co-accused nothing has been brought on record. Learned counsel for the applicant has rightly relied upon the order passed by the Hon'ble Apex Court in case of Vijay Singh Vs State of Haryana, reported in 2023 SCC OnLine SC 1235, which order is reproduced as under :-
1. The petitioner is alleged to have committed offences under Sections 15 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985(hereinafter called the 'NDPS Act"). His application for anticipatory bail was rejected
3 13aba231.2026.odt by the High Court. The allegations in the FIR are that 1.7 Kg of Poppy Straw (Doda Post) was recovered from the co-accused. The petitioner concededly was not present at the spot but was named by the co-accused. That apart there is no other material to implicate the petitioner. The prosecution urges that another case with allegations of commission of offence under NDPS Act are pending against the petitioner. It is not denied that in those proceedings he was granted bail.
2. Having regard to these circumstances, the petitioner is directed to the enlarged on anticipatory bail, subject to such terms and conditions as the trial Court may impose"

Considering the aforesaid facts, the following order is passed.
ORDER
a] The criminal application is allowed.
b] In the event of arrest, in connection with Crime No. 23/2026 registered with Police Station, Nandanvan, District Nagpur, for the offence punishable under section 8(c), 22(c), 20(b)(ii)(a) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, the applicant- Roshan Vinayak Rohankar, be
4 13aba231.2026.odt released on anticipatory bail on furnishing a P.R. bond of Rs. 25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety in the like amount.
c] The applicant shall attend the concerned Police Station on 30/04/2026 and 1st May 2026 to 03/05/2026 between 10.00 a.m. to 12.00 p.m. and thereafter, as and when called by the investigating officer.
d] The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses.
e] The applicant shall not leave the India without prior permission of the Court.
