The applicants are apprehending their arrest in connection with Crime No13/2026 registered with Police Station, Mankapur, District Nagpur for the offences punishable under Sections 351 (3), 189(2), 189(1), 189, 336(3), 336(2), 318(2) of the Bhartiya Nyaya Sanhita, 2023.

The contention is that inspite of the complainant selling the plot property to his wife Smt. Rekha Kawale through Power of Attorney, the applicant no.1 again sold the same plot to Sushma Inder Shahu.

Issue notice to the non-applicant, returnable on 15.04.2026.

Shri Lokhande, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply.

Considering the submissions and the nature of
56 aba239.26.odt allegations, a detailed scrutiny of the case diary is necessary, which is not available at present. In the meanwhile, the applicants can be granted ad interim protection. Hence, the following order:
ORDER
(i) Pending the application, in the event of arrest in connection with Crime No13/2026 registered with Police Station, Mankapur, District Nagpur for the offences punishable under Sections 351 (3), 189(2), 189(1), 189, 336(3), 336(2), 318(2) of the Bhartiya Nyaya Sanhita, 2023, the applicant - (1) Deepak s/o Vitthalprasad Dube and (2) Mrs. Rashmi w/o Anurag Joshi be released on bail on furnishing a PR bond of 25,000/- each with one solvent ₹ surety each in the like amount.
(ii) Applicant no.2 shall attend the concerned Police Station on Wednesday and Saturday between 10.00 am to 12.00 noon for the next two weeks and cooperate with the investigating authority.
(iii) Applicant No.1 shall cooperate in the investigation. (iii) The applicants shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
