The applicants are seeking anticipatory bail in connection with Crime No. 253/2026, registered with Police Station Barshitakli, Dist Akola, for the offences punishable under Sections118(1), 118(2), 189(2), 190, 191(2), 191(3), 324(4) and 351(2) of Bharatiya Nyaya Sanhita, 2023. 3.
Issue notice to the non-applicant, returnable on 21.4.2026.

Learned APP waives notice on behalf of nonapplicant/State. 5.
The contention is that there was a dispute between the complainant party and the accused party. Applicant
No. 1 is alleged to have assaulted the complainant party by means of kick blows. It is contended that in the incident, the applicant also got injured and a counter FIR has also been lodged by applicant No.1. It is also submitted that there is no allegation of assault against the other applicants. The only allegation against them is that they have damaged the head light of the tractor.

Considering the submission that a counter FIR has also been lodged and applicant No.1 has also gotten injured in the incident, possibility of free fight between the applicant group and the complainant group cannot be ruled out. Perusal of the Case Diary is necessary which is not available today. Considering the submissions, a case is made out for grant of ad interim relief. Hence, following order is passed: i) Pending the application, in the event of arrest in connection with Crime No. 253/2026, registered with Police Station Barshitakli, Dist Akola, for the offences punishable under Sections118(1), 118(2), 189(2), 190, 191(2), 191(3), 324(4) and 351(2) of Bharatiya Nyaya Sanhita, 2023, the applicant, namely, Ankush s/o Vishnupanth Ingle, Babarao Ganpath Ingle, Vishal Babarao Ingle, Shubham Sunil Ingale and Akshay s/o Sunil Ingle be released on furnishing a P.R. bond of Rs. 25,000/- each with one solvent surety in the like amount.
ii) The applicants shall attend the concerned Police Station every Friday and Tusday,between 10.00 to 12.00 hrs., for two weeks.
iii) Appearance before the Investigating Officer may be treated as a custody within the meaning of Section 23 of Bharatiya Sakshya Adhiniyam, 2023.
