The Applicant is apprehending arrest in connection with Crime No. 239 of 2025, registered with Madha Police Station, District Solapur, for offences punishable under Sections 109, 118(1), 351(2), 351(3), 352, and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Issue notice to the non-applicant, returnable on 10.06.2026. 3.

Shri Yadav, learned APP, waives service of notice on behalf of the nonapplicant and seeks time to file a reply.

It is contended that the Applicant is a doctor who has recently completed his MBBS. The complainant is the uncle of the Applicant. The allegation against the Applicant is that he assaulted the Complainant with the wooden handle of a pickaxe on his head as a result of which, the Complainant sustained a head injury.

Learned Counsel appearing on behalf of the complainant submits that the incident occurred in spur of a moment, and that the complainant now, upon reflection, has no grievance against the Applicant. 6.

Considering that the nature of the injury appears to be simple, a detailed scrutiny of the case diary is required, which is not available today. 7.

Considering the submissions as well as the fact that the Applicant is a medical professional, coupled with the nature of the injury which prima facie appears to be simple, a case is made out for grant of ad-interim relief, subject to stringent conditions. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No. 239 of 2025 registered with Madha Police Station, District Solapur, for the aforesaid offences, the Applicant-Chaitanya Bibhishan Chaugule, shall be released on bail upon furnishing a P.R. bond of 25,000/- with one solvent surety in the like amount. ₹

(ii) The Applicant shall attend the concerned Police Station every Thursday and Monday between 10:00 a.m. and 12:00 noon for a period of one week and shall cooperate in the investigation. (iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (iv) Presence of the Applicant before the Investigating Officer shall be treated as custody within the meaning of Section 23 of the Bharatiya Sakshya Adhiniyam.
