The applicant is apprehending his arrest in connection with Crime No.428/2026 registered with Police Station, Bhadravati, District Chandrapur for the offences punishable under Sections 109(1), 126(2), 189(1), 189(2), 189(4), 190, 191(2), 296 and 351(3) of the Bhartiya Nyaya Sanhita, 2023.

The contention of the applicant is that except assault by means of kick blows no other role has been attributed to the applicant. Even the alleged assault by means of knife has not caused any injury to the victim. The said allegations are against the co-accused who assaulted the victim. According to the learned counsel for the applicant, the offence punishable under Section 109 is not made out. The applicant is a government servant working with MAHAGENCO and has good reputation.

Issue notice to the non-applicant, returnable on 27.04.2026.

Ms Kolhe, learned APP waives service of notice on behalf of the non-applicant and prays for time to file reply. 5.

Considering the submissions and the nature of allegations, a detailed scrutiny of the case diary is necessary, which is not available at present. No reply is filed by the State, since they are yet to be served. In the meanwhile, the applicant can be granted ad interim protection. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No.428/2026 registered with Police Station, Bhadravati, District Chandrapur for the offence punishable under Sections 109(1), 126(2), 189(1), 189(2), 189(4), 190, 191(2), 296 and 351(3) of the Bhartiya Nyaya Sanhita, 2023, the applicant - Santosh Latari Junghare be released on bail on furnishing a PR bond of 25,000/- with ₹ one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police Station on every Saturday and Sunday between 10.00 am to 12.00 noon for the next two weeks and cooperate with the investigating authority.

(iii) The applicant shall not tamper with the prosecution evidence and shall not threaten the prosecution witnesses. (M.W. Chandwani, J.) Wagh
