During the course of hearing, it was noticed that according to First Information Report, one Sheikh Shahrukh Sheikh Mehboob has suffered the injury. On being inquired from the learned APP and the Investigating Officer, who is present in the Court, it was told that in spite of two letters issued to the Medical Officer, Government Hospital, Nagpur City Nagpur, requesting for providing the medical papers and injury certificate, no reply is given by the Medical Officer. The offence registered is under Sections 109, 115(2), 189(2), 190, 191(2), 191(3) 296, 351(3) of the Bharatiya Nyaya Sanhita, 2023, Section 4 and 25 of the Arms Act, 1959 and 135 of the Maharashtra Police Act, 1951. 3.

Because of non availability of the injury certificate on

2 7aba258.2026..odt record, the Court is not in a position to take appropriate call. Prima facie, it reveals that the evidence is tried to be withheld. 4.

In that view of the matter, papers of investigation be placed before the Commissioner of Police, Nagpur City Nagpur. The Commissioner of Police is requested to go through the case papers and file his affidavit on or before 8.5.2026. 5.
