: M.W. CHANDWANI, J.

DATE : 5th May, 2026.

P. C. :

1.

The Applicant is apprehending arrest in connection with Crime No. 106 of 2026, registered with Vishrambaug Police Station, District Sangli, for the offences punishable under Sections 118(1) and 85 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023.

2.

Issue notice to the non-applicants, returnable on 09.06.2026. 3.

Mr. Naik, learned APP, waives service of notice on behalf of nonapplicant no. 1 and seeks time to file a reply. 4.

Heard the learned Counsels for the respective parties.

5.

On oral request, permission to intervene on behalf of the Complainant is granted.

6.

It is contended that the present FIR filed by the wife on 25.03.2026 against the Applicant and his parents is a counterblast to the FIR lodged by the present Applicant on 13.03.2026 against his in-laws for assault arising out of a matrimonial dispute between the Applicant and the Complainant. 7.

It appears that the Applicant has lodged a complaint against his in-laws alleging that they assaulted him and his parents at the Applicant's residence. It further appears that owing to matrimonial discord, a dispute exists between the Applicant's family and the Complainant. 8.

Considering the submissions, a detailed scrutiny of the case diary is required, which is not available today. Meanwhile, the Applicant can be protected by way of ad-interim relief. Hence, the following order:

ORDER

(i) Pending the application, in the event of arrest in connection with Crime No. 106 of 2026, registered with Vishrambaug Police Station, District Sangli, for offences punishable under Sections 118(1), and 85 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, Applicant-Prashant Hindurao Padalkar, shall be released on bail upon furnishing a P.R. bond of 25,000/- with one solvent surety in the like ₹ amount.
