Apprehending arrest, the applicant has preferred this application for anticipatory bail in connection with Crime No. 9/2026, registered with Police Station Pachgaon, Nagpur Rural, for offences punishable under Sections 318(4), 338, 336(3), 340(2) r/w Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.

The learned Senior Counsel, at the outset, has submitted that the FIR in question has not been uploaded on the website of the Maharashtra Police. He has contended that in the present application, he has prayed that a direction be issued to the nonapplicant/respondent to produce a copy of FIR. The learned Senior Counsel submits that since the copy of FIR is not supplied, for want

2 4aba278.2026..odt of necessary information, details about the offence are not given in the application. My attention is drawn to the order dated 8.4.2026, on the Anticipatory Bail Application filed by the applicant and passed by the District Judge -22 and Addl. Sessions Judge, Nagpur by which the application was rejected. He has also invited my attention to the order passed by the said Court on 4.4.2026, by which ad-interim bail was granted to him. According to learned Senior Counsel, the applicant is working on the post of Assistant Professor at Govindrao Wanjari College of Engineering and Technology, Nagpur since 2014 and has an unblemished service record. The learned Senior Counsel also contended that the present applicant has no criminal antecedents.

The allegations made by the non-applicant are that the present applicant has accepted an amount of Rs. 1510 on 1.8.2025 and Rs. 5,000/- on 11.9.2025 for preparing and uploading a bogus caste validity certificate. According to him, the role of the applicant is extremely limited as he would not have been benefited from uploading incorrect document. Per contra, according to the learned APP, since, the investigation is at an initial stage, the present application may not be allowed.

Issue notice to the non-applicant, returnable on 22.4.2026. 5.

Learned APP waives notice on behalf of the non-applicant.

With assistance of the learned counsels for the respective parties, I have gone through the record.

The Hon'ble Apex Court in the case of Youth Bar Association of India Vs. Union of India, reported in 2016(9) SCC 473, has categorically stated that the FIR is required to be uploaded on the website of the police within seven days, normally. The applicant has prayed that the non-applicant be directed to produce a copy of the FIR for perusal of this Court.

Be that as it may, at this stage, it would not be appropriate to comment anything on that aspect. Suffice it to say that the allegation against the present applicant is that he has demanded Rs. 1510/- on 1.8.2025 and Rs. 5,000/- on 11.9.2025 for uploading a bogus caste validity certificate. The fact cannot be ignored that the applicant is a Professor and has no criminal antecedents. Presently, since the case is based on documentary evidence, immediate custodial interrogation may not be required, hence, the following order is passed:

ORDER

i) In the event of arrest, in connection with Crime No. 9/2026, registered with Police Station Pachgaon, Nagpur Rural, for offences punishable under Sections 318(4), 338, 336(3), 340(2) r/w Section 3(5) of the Bharatiya Nyaya Sanhita, 2023,

4 4aba278.2026..odt the applicant shall be released on ad-interim bail on furnishing a P.R. bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one solvent surety in the like amount. ii) The applicant shall attend the concerned Police Station on 19.4.2026, between 10.00 Hrs to 12.00 Hrs.

iii) The applicant shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses.

iv) The applicant shall not leave India without the previous permission of the Court.
