Apprehending the arrest in connection with Crime No.354/2024 registered with Police Station, Dahihanda, Tah. Akot, District Akola for the offences punishable under Sections 420, 468, 471 read with Section 34 of the Indian Penal Code (for short, "IPC"), the applicants/accused nos.1 and 2 have approached this Court.

The learned counsel for the applicants has contended that though their anticipatory bail application was rejected by the Sessions Court in the year 2024 but the application of co-accused - Ku. Komal Sable was allowed by this Court on 01.04.2026 in Criminal Application (ABA) No.186/2026 and anticipatory bail was granted. Thus, he submitted that same recourse be taken in the present case.

Per contra, the learned APP has contended that the allegations against the present applicants are serious and therefore the application be rejected.

With the assistance of respective learned counsels, I have gone through the order passed by Coordinate Bench of this Court on 01.04.2026 in Criminal Application (ABA) No.186/2026 granting anticipatory bail to co-accused Ku. Komal Shrikrishna Sable; so also order dated 25.11.2024 passed in Criminal Application (ABA) No.787/2024 granting anticipatory bail to Suraj Laxman Pande.

In short, it is alleged in the First Information Report that the Shri Maruti Sansthan, Taroda, a Trust registered under Bombay Public Trusts Act, was entitled to claim the subsidy due to natural calamities. The present applicants alongwith the others by forging the signatures on the consent letter of the other trustee uploaded those documents on the portal of the Government for claiming the subsidy. When the informant came to know about the aforesaid fact he immediately approached the Tahsildar and ultimately, the amount could not be disbursed. It is in this background, the First Information Report is lodged.

Considering the nature of allegations made and the fact that co-accused are already granted anticipatory bail by this Court, till filing of reply by the State, I am inclined to protect liberty of the applicant. Accordingly, the following order is passed:

ORDER

i.

Issue notice to the non-applicant, returnable on 24.04.2026.

ii.

Ms Sapkal, learned APP waives service notice for nonapplicant/State and prays for time file reply. iii.

In the event of arrest in connection with Crime No.354/2024 registered with Police Station, Dahihanda, Tah. Akot, District Akola for the offences punishable under Sections 420, 468, 471 read with Section 34 of the Indian Penal Code, applicants - (1) Manohar s/o Mahadev Sable and (2) Shrikrishna s/o Manohar Sable, shall be released on ad interim bail on furnishing a PR bond of 25,000/- ₹ [Rupees Twenty Five Thousand only] each with one solvent surety each in the like amount.

iv.

The applicants shall attend the concerned Police Station on 21st and 22nd April 2026 between 12.00 noon to 02.00 pm.

v.

The applicants shall cooperate with the investigating agency and shall not tamper with the prosecution evidence or influence the witnesses directly or indirectly. vi.

The applicants shall not leave India without prior permission of this Court.
